New York State Reciprocal Agreements

Employees residing in one of the reciprocal states can submit Form WH-47, Certificate Residence, to apply for an exemption from Indiana State income tax. Reciprocal agreements between states allow workers who work in one state but live in another to pay only income taxes to their state of residence. If reciprocity exists between the two states, staff must complete a certificate of non-residence and give it to you so that the tax on the place of residence can be withheld in place of the workplace tax. Use our chart to find out which states have mutual agreements. And find out what form the employee needs to fill out to withhold you from the state of origin: when the employee submits his or her individual tax return, he files a tax return for each state in which you withheld your taxes. It is likely that the employee will receive a tax refund or a credit for taxes paid to the state of work. This Bulletin explains the New York State Tax Credit and the Local Reciprocal Use Tax Credit that may be authorized for sales or user taxes you have paid in another state or in another New York State country. For sales tax and use purposes, you are established in the state and in any place where you have a permanent place of residence or where you keep another person for your use. A resident buyer must pay New York State public tax to the tune of 4% (plus the 3/8% tax, the local user tax is levied in the Metropolitan Commuter Transportation District) and the local usage tax, which is directly due to the IRS, by deposit: for example, in County X, where the combined public and local tax is 7% (4% federal tax and 3% local tax), ABC Corp.

buys a new computer for $800 and pays $56.00 in VAT. ABC Corp. then takes the computer to Y County for a mission to its main office. The combined government and local tax in Y County is 8% (4% federal tax and 4% local rate). As ABC Corp. was a resident of Y County when it purchased the computer, it owes Y County a local usage tax on the purchase price of the computer. However, the local tax on the revenue paid to County X at the time of purchase is allowed as a local use tax credit due to Y. ABC County Corp. calculates its Y County Use Tax, the VAT credit paid by County X at the time of purchase and the net amount of the user tax due as follows: Ohio has a state tax margin with the following five states: If you claim a mutual credit you should be able to justify it: Since State 2 authorizes a mutual credit only for the New York State Tax, New York only allows a reciprocal credit for the public tax paid to the state 2.

Local tax paid to state 2 is not allowed. Calculate your New York use tax debt, eligible reciprocal assets and the net user tax due as follows: Instead of a dual source and double taxation, the worker`s home state can credit the amount withheld for his or her state of work.
